Terms and Conditions for NEBULA Online Examination System

1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the NEBULA Online Examination System (“NEBULA”, “we”, “our”, or “us”). By registering or using NEBULA, whether independently or through an institution, you agree to comply with these Terms.
If you do not agree to these Terms, you must not use the platform.

2. Eligibility
To use NEBULA, you must:
- Be a registered student, tutor, or administrator from an accredited institution; or
- Be an independent learner legally capable of entering a binding agreement.
If you are a minor, parental or institutional consent is required.

3. Account Registration
- Users must provide accurate, complete, and up-to-date information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- Sharing of login credentials is strictly prohibited.
- We reserve the right to suspend or delete accounts that violate our policies.

4. User Responsibilities
As a user, you agree to:
- Use NEBULA only for lawful and academic purposes.
- Comply with exam rules, time limits, and integrity standards.
- Refrain from using external aids during assessments unless explicitly permitted.
- Not attempt to hack, copy, or reverse-engineer any part of the system.

5. System Use & Availability
- NEBULA aims for 99% uptime but does not guarantee uninterrupted access.
- We may perform scheduled maintenance and updates without prior notice.
- In case of a system outage, BengySoft Systems is not liable for missed exams or damages.

6. Prohibited Conduct
You agree not to:
- Impersonate another person or provide false information.
- Disrupt or interfere with the operation or security of the platform.
- Upload malicious code or engage in fraudulent activity.
- Use NEBULA to distribute spam, malware, or unauthorized content.

7. Intellectual Property
- All content, software, logos, and exam materials within NEBULA are the intellectual property of BengySoft Systems or respective institutions.
- You may not reproduce, modify, or distribute any content without written permission.

8. Privacy
Your use of NEBULA is subject to our [Privacy Policy], which outlines how we collect, store, and protect your data. Continued use implies your consent to data processing under our stated terms.

9. Exam Proctoring
You consent to the use of:
- Session monitoring
- Screen tracking
- Camera and microphone access (when required)
This is used solely to uphold academic integrity. You will be notified in advance before any monitoring begins.

10. Termination of Access
We may suspend or permanently terminate your access if you:
- Breach these Terms or exam guidelines
- Attempt to compromise system integrity
- Are involved in impersonation or academic fraud
Termination may occur without prior notice.

11. Limitation of Liability
- BengySoft Systems is not liable for any indirect or consequential loss due to system usage.
- We do not guarantee specific academic outcomes or exam results.
- You are responsible for maintaining a suitable device and stable internet connection.

12. Modifications to Terms
We reserve the right to update these Terms at any time. Users will be notified via the platform or email. Continued use after updates constitutes acceptance.

13. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved in the courts of competent jurisdiction within Ghana.
